The victim's surviving spouse can step in and pursue the decedent's claim against the defendant. The surviving spouse and children can also pursue a separate wrongful death claim against the defendant for their damages incurred in the decedent's death. These claims are separate; however they can be consolidated by the court before trial.

The personal representative can be the administrator or executor of the estate as appointed in the will of the deceased.
